For unknown reasons, on 19 February 2019. the process was declared closed, so now we are deprived of the opportunity to see and hear what is happening in the process, learn about the arguments of the defendant and representatives of government agencies.
Meanwhile, by virtue of article 11 of the Arbitration procedural code of the Russian Federation, the proceedings in arbitration courts shall be open. The trial in a closed court session is allowed in cases if open trial can lead to disclosure of state secrets, in other cases envisaged by the Federal law and also under the petition of the person participating in business and referring to necessity of preservation of commercial, official or other secrets protected by law.
It is clear that in this case, any information constituting a trade secret ofshornikov, in fact no, not about the commercial aspects of the RMK it is, moreover, in virtue of paragraph 4 of article 5 of the Federal law "On commercial secret", mode of trade secrets can not be installed by persons engaged in entrepreneurial activities, in respect of the following information about environmental pollution, state fire safety, sanitary-epidemiological and radiation environment, food safety, and other factors that have a negative impact on the safe operation of production facilities, security of each citizen and safety of the population as a whole.
In this case, we are talking about life, health and property safety of tens of thousands of South Urals.
We have a right to know, as it is considered without exaggeration crucial for Chelyabinsk and region business. And therefore, we believe that this dispute should be considered in an open and transparent process.
